Affiliate Terms and Conditions

1. Introduction

As a user of ShortGenius ("Company"), operated by RemoteAmbition, LLC ("RemoteAmbition"), and participant in our Affiliate Program ("Program"), you agree to abide by the terms and conditions outlined in this Affiliate Program Agreement ("Agreement"). Please read the entire Agreement carefully.

Your participation in the Program is solely for the purpose of legally advertising our website and services to receive commissions on memberships and products purchased by individuals referred to ShortGenius through your personal affiliate link or trackable coupon.

By using the affiliate link or trackable coupon provided to you upon signing up as a user of ShortGenius, you indicate your acceptance of this Agreement and its terms and conditions.

2. Acceptance of Affiliate Terms

By signing up as a user of ShortGenius and using the affiliate link or trackable coupon provided to you, you automatically become an Affiliate and agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you should not use your affiliate link or coupon code.

3. Commission Structure

Commissions typically range from 20% to 30%, depending on specific terms arranged with the Affiliate. Commissions will be paid monthly via PayPal, provided the minimum balance for payout is at least $50. For an Affiliate to receive a commission, the referred account must remain active for a minimum of seven (7) days.

You cannot refer yourself, and commissions are only paid on the first order of a new customer. If someone clicks your link or uses your coupon code and orders multiple accounts, you will receive a commission on the first account only.

Payments are issued only for transactions that have been successfully completed. Transactions resulting in chargebacks or refunds are not eligible for commission payouts.

4. Termination

Your participation in the Program may be suspended or terminated for any of the following reasons:

  • Inappropriate Advertising: Including but not limited to false claims and misleading hyperlinks.
  • Spamming: Such as mass emails or mass newsgroup postings.
  • Illegal Activities: Advertising on sites promoting illegal activities.
  • Failure to Disclose: Not disclosing the affiliate relationship in promotions that qualify as endorsements under existing Federal Trade Commission guidelines or applicable state laws.
  • Intellectual Property Violations: Using ShortGenius's trademarks without permission. We reserve the right to require license agreements to protect our intellectual property rights.
  • Unauthorized Incentives: Offering rebates, coupons, or other forms of promised kickbacks from your affiliate commission as an incentive. Adding bonuses or bundling our services with other products is acceptable.
  • Fraudulent Activities: Including self-referrals, fraudulent transactions, or suspected affiliate fraud.

ShortGenius reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or without cause.

5. Affiliate Links and Coupons

You may use the affiliate link and trackable coupon code provided to you to promote ShortGenius's services on your website, within your email communications, and through other marketing channels. You may also advertise ShortGenius's website in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us or create your own, provided they are appropriate and not in violation of any conditions outlined in Section 4.

6. Coupon and Deal Sites

ShortGenius occasionally offers coupons to select affiliates and newsletter subscribers. Unless you have been pre-approved or assigned a specific, branded coupon, you are not allowed to promote any coupons beyond the one provided to you.

The following terms apply to any Affiliate considering the promotion of our products in relation to a deal or coupon:

  • Affiliates may not use misleading text on affiliate links, buttons, or images to imply that anything besides currently authorized deals are available to the specific affiliate.
  • Affiliates may not bid on keywords or phrases containing "ShortGenius Coupons", "ShortGenius Discounts", or other terms implying the availability of coupons beyond those provided to them.
  • Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other visible or invisible actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button, or image for that particular coupon or deal. Your link must direct the visitor to the merchant site.
  • Users must be able to view coupon/deal/savings information and details before an affiliate cookie is set (e.g., "click here to see coupons and open a window to merchant site" is not allowed).
  • Affiliate sites may not have "Click for (or to see) Deal/Coupon" or any variation when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the landing page will be removed from the Program immediately.

7. Pay Per Click (PPC) Policy

PPC bidding is not allowed without prior written permission.

8. Liability

ShortGenius will not be liable for indirect or accidental damages (including loss of revenue or commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or our website(s).

We make no express or implied warranties with respect to the Program and/or the services or products sold by ShortGenius. We do not guarantee that the operation of the Program and/or our website(s) will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

9. Term of the Agreement

The term of this Agreement begins upon your acceptance into the Program, which occurs when you sign up as a user of ShortGenius and receive an affiliate link or trackable coupon, and will end when your Affiliate account is terminated.

We may modify the terms and conditions of this Agreement at any time. If any modification is unacceptable to you, your only option is to cease using your affiliate link or coupon code and terminate your participation in the Program. Your continued participation in the Program will constitute your acceptance of any changes.

10. Indemnification

You agree to indemnify and hold harmless RemoteAmbition, LLC and its affiliates, subsidiaries, officers, directors, employees, agents, licensees, successors, and assigns, including those licensed or authorized by RemoteAmbition, LLC to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable attorney's fees) arising out of or related to any claim sustained in connection with your participation in the Program due to your negligence, misrepresentation, failure to disclose, or intentional misconduct.

11. Governing Law, Jurisdiction, and Attorney's Fees

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising under or related in any way to this Agreement shall be adjudicated exclusively in the state courts located in Volusia County, Florida.

12. Electronic Acceptance

This Agreement is an electronic contract that sets out the legally binding terms of your participation in the ShortGenius Affiliate Program. By signing up as a user of ShortGenius and using the affiliate link or trackable coupon provided to you, you consent to this Agreement and all the terms and conditions contained or referenced herein. This action creates an electronic acceptance that has the same legal force and effect as a handwritten signature.

13. No Separate Affiliate Signup Required

By automatically receiving an affiliate link or trackable coupon upon signing up as a user, you are enrolled in the Affiliate Program without the need for a separate sign-up process. Your use of the affiliate link or coupon code signifies your agreement to these terms and conditions.
